Self Determination represents one of the principles which the international law calls for, it confirms the right of people to choose the formula in which they practice their national sovereignty and choose their political system freely without any external intervention. The international law through its applications to Self Determination selects the principles upon which such people depended on.

 

Self Determination is one of the basic principles of Human Rights. They confirmed the individual and individual rights of free choice to political, economic, social and cultural systems. The principle of Self Determination was connected with the process of ending colonial systems.

 

The introduction and first material of charter of the United Nations in 1945 gave a priority to respect the principle of Self Determination. International Court of Justice reassured that Self Determination is primarily a right of the people not the governments alone. 

 

The United Nations conducted two important studies on Self Determination. They included the major factors that lead people to call for Self Determination. Two of the major factors were that the right of people to rule themselves on a land and people’s desire and their ability to rule themselves.

 

Self Determination is one of the legislations that are not considered as controversial issues. Non-controversial legislations represent the highest

levels of working with international law and require complete commitment in them every time. International Court of Justice and other interested organizations in human rights have sentenced or issued in cases supporting the Self Determination.

 

The legislations included what means that its applications are applied on everyone and the policies of states must commit that. It is necessary to allow the international community to respect and do their commitments in all conditions of relations between countries.

 

The principle of Self Determination has become a guiding principle to reconstruct Europe since the end of World War I. The Charter of the United Nations was considered as a global recognition of Self Determination as a basis to protect the international relations and make peace. It also recognized the right of people in Self Determination in the International Treaty on Political and Civil Rights and International Treaty on Economic, Cultural and Social Rights.

 

All the people have the right of Self Determination. For Arab countries, the first country which needs Self Determination is Palestine which looks forward to establish its national state on its land according to the international legislation.

 

When people practice Self Determination, it leads to independence. The Right of Self Determination can select the objectives that people want. Nations call for Self Determination and forming national governments.

 

One of the charters that recognize Self Determination regionally and internationally was Declaration of the Principles in the international law which was adopted by the United Nations General Assembly in 1970 and Helsinki Declaration which was adopted by the Conference on  Security and International Cooperation  in 1975, and the African Charter of Human Rights in 1981.

 

Renewing the Arab Charter of Human Rights was adopted in the Arab Summit in 2004 and was applied in 2008. Arabs need more experiences in the Humanitarian Work and develop their procedures especially in the regions where public revolutions have been taking place. Civil Society Organizations can contribute by clarifying the procedures and support the efforts of Arab League through different technologies.
